I (We), (Et Al), ________, hereafter referred to as Client(s), are required to acknowledge the terms set forth in this Waiver for the listed project(s) to be performed: _____________________________________________

Client Supplied Material Disclaimer & Liability Waiver

In order to avoid any potential complications or misunderstandings, please be aware of the following obligations that you assume, when you choose to have Bullard Custom Tile & Flooring, Inc. (Et Al), work with Client-Supplied Materials.

•  As the supplier of the materials for your project, you hereby assume full responsibility and liability for ordering the correct material(s), the correct amount needed and any associated products. Client(s) agrees to have these materials on the job site with ample time prior to installation, allowing time for returns and replacements if needed.

•   In the event of defective, missing, damaged or wrong materials being ordered or delivered, changes in dye lots, or any other problem concerning your supplied materials and products, you agree that you will assume full responsibility and liability for returning or exchanging them, as well as, negotiating the terms of the resolution with the provider.

•   As the supplier of said materials, please inspect all tiles for breakage, size, thickness gage and continuity before the installation process begins. Client(s) assumes full responsibility and liability for their products and Bullard Custom Tile & Flooring, Inc. is released from liability for the end result of your project based on the materials that you have provided.

•    As the supplier of the materials, you assume full responsibility and liability for assuring that all materials will be present and of the required amount, on the job site, and in good condition prior to the installation timeframe of the product.

•   You hereby understand that missing, damaged, broken, deflective or wrong materials may alter our work schedule and may result in additional time charges to you at a rate of $250.00 per day, (up to 7 days) then we will have to proceed to our next client and reschedule your project.

·                 In the event of delays or rescheduling the start date of your project, which is not due to any complications on your part, Bullard Custom Tile & Flooring will give you a notice as soon as we are aware of any shift in the schedule, due to material delivery delays or previous client delays.

•   Client(s) assumes full responsibility and liability for obtaining all guarantees and any warranties pertaining to these materials by the manufacturer.

•    Client(s) shall hold Bullard Custom Tile & Flooring, Inc (in its entirety), harmless for any product or installation malfunctions related to the products you have provided. Please inspect all materials before the installation process begins.

•    The above conditions do not encompass all possible circumstances that could delay work or result in additional job costs stemming from owner supplied materials.

• If you are using other contractors or trades on your project, it is your responsibility to coordinate scopes of work, scheduling, and manage the order in which the project is completed. Bullard Custom Tile & Flooring, Inc. is not, nor is acting as a General Contractor.

Natural Stone Waiver

What is Natural Stone? “Natural Stone” refers to several natural products quarried and made from the earth, used over many thousands of years as building materials and decorative enhancements. These products include Granite, Marble, Limestone, Travertine, Slate, Quartzite, Sandstone, Saltillo, Terra Cotta, Onyx, and many others. They are more than just rocks - natural stone is handmade or selected from the best, most consistent sources for durability and beauty. Natural stone products differ in composition, color, and texture even among pieces from the same source. This enigmatic nature of the product lends itself to a one-of-a-kind design and distinctive, dramatic applications.

What are care and maintenance of the stone products are recommended?

Stone surfaces are very easy to maintain. Clean stone floors with warm water and a mild liquid soap. Never use acid cleansers or abrasive chemicals on stone. Natural stone should be sealed after installation and periodically thereafter, depending on its usage.

I have read and understand the characteristics and tendencies of using natural stone for my project. I also understand that there may be extra charges involved with using natural stone due to the excessive weight challenges, specialty products required and additional shipping charges.

*Note: Please inspect all tiles for breakage, size and levelness before the installation process begins. Natural stone products inherently lack uniformity and are subject to breaking, cracking, variations in color, shade, finish, etc. Extra material is required to allow for unusable, defective tiles. It is recommended to blend tiles from different boxes when installing. We will not pick out individual colors from the mix. Natural stones may be characterized by dry seams, holes and pits that are often filled with grout. The grout can eventually work its way out and it may be necessary to refill these voids as part of a normal maintenance procedure. All-natural stone products should be sealed with a penetrating sealer. Special stone cleaning procedures are recommended.

I hereby release Bullard Custom Tile & Flooring, et all, from any liability associated with using natural stone for my project.

ACCEPTANCE & ACKNOWLEDGMENT OF PROJECT, PLANS & TERMS

Client(s) hereby understand that proper working conditions are required in order to perform the work in your home.

·          We must have a protected area to store materials and supplies.

·          We must have a protected area from the weather to operate the tile    saw.

·          We must have access to water, a temperature-controlled environment above 55 degrees.

·         Lights and electricity in the area that we will be working in on the day that we arrive to start your project.

·         Any delays in our start date for this reason will have a $250.00, per day fee, for a maximum of 7 days and then your project will be rescheduled until the conditions specified above are in place and work within our schedule. Any start delays of your project will affect the client who is scheduled proceeding you.

Client(s) hereby acknowledges that any additional work required will add extra charges as a result of-

·          concealed damage

·          mold abatement

·          asbestos removal

·          requests for changes

·          deviations or alterations to the work being performed according to the agreed upon plan.

·          and any necessary work required for our outlined installations.

·          Any extra charges will be added to a separate addendum onto your invoice.

Any work that is required, that does not include our tile and flooring installation services, are the responsibility of the client(s) to resolve.

Bullard Custom Tile & Flooring, Inc. is not a General Contractor. If the client(s) require help with scheduling and organizing the work process, this service can be requested, and the appropriate fee will be added to the addendum. Client(s) understands that Bullard Custom Tile & Flooring, Inc. is not responsible for acquiring any permits. Any required permits will be provided by the homeowner or by the enlisted subcontractors. Bullard Custom Tile is not required to provide a permit for cosmetic work.

Internet technology does not allow for completely accurate reproduction of colors, sizes or textures of materials. Client(s) hereby release Bullard Custom Tile & Flooring, Inc. from any liability associated with color, details, textures, etc. of materials.

Client(s) agrees to have images and photographs of their project used in online advertising or in any publications.

Client(s), et all, agree that they will not use, social media posts or public posts, etc., to transmit or broadcast any malicious, defamatory, slanderous, or libelous content which could hereby harm Bullard Custom Tile & Flooring, Inc.’s business reputation and, or prevent future business operations which is a legally prosecutable act.

Bullard custom tile is not responsible for any damages, complications, sounds, or additional work required as a result of previous work performed on the areas that we are now hired to perform our services on.

All materials that Bullard Custom Tile & Flooring, Inc. has purchased for your project are non-refundable and we do not offer any product guarantees, product warranties, or have any association with the manufacture regarding any defects with the products used. We do offer a workmanship guarantee for 1 month following the completion date of your project.

ILLNESS OR COVID-19: Client(s) understand the present risks involved with contagious illnesses and with Covid-19 exposure and hereby agree to have members of Bullard Custom Tile & Flooring work within their home. Client(s) agrees to hold Bullard Custom Tile & Flooring harmless and release Bullard Custom Tile & Flooring from any liabilities associated with contagious illnesses or Covid-19. Bullard Custom Tile & Flooring will not perform any work if any of our team is exhibiting any symptoms and Client(s) agree to inform Bullard Custom Tile & Flooring if they are experiencing any symptoms of a contagious illness or test positive for Covid-19 and work will be postponed until a health clearance is provided. Client(s) agrees not to hold Bullard Custom Tile & Flooring responsible for work which has been delayed due to reported illness symptoms or, Federal, State and Local Government restrictions.

We reserve the right, in our sole discretion, to change, modify, add, or remove portions of these Terms at any time, and you hereby agree to be bound by such modifications or revisions. It is your responsibility to check the Terms periodically, which are posted on our website, because any changes will be binding to you. By the use of our Services, after those revisions become effective, you agree to be bound by the revised Terms.

If you accept the proposed Estimate, Invoice and Waiver presented here, please sign and return the documents asap so that we can make arrangements to get your project onto the work schedule with your nonrefundable, 10% deposit payment.

All projects begin with a 50% down payment 21 days before your estimated start date. Weekly progress payments, based on the number of weeks to completion divided by the remaining balance, are scheduled to be paid on Fridays. Please check your email for updates.

I (we) understand, and will attest, that the work performed meets satisfactory requirements with their final payment. Failure to pay in full on the day when the project is completed will result in late fees and a collection process, which could lead to negative credit reporting and legal ramifications. Client(s) hereby agrees to settle any disputes by contacting us in writing first and by giving us an opportunity to resolve any issues. If a resolution for nonpayment cannot be reached, a lien will be filed on your property and any further resolution processes will be handled with the use of an Arbitration Service at the Clients’ expense.

We, (I) have read, acknowledge, and hereby understand and agree to the terms outlined in the Estimate, Invoice and this Waiver Packet presented.

All expressed and applied terms and conditions defined herein hereby apply with the acceptance of the Estimate, my (our) non-refundable 10% deposit payment, the presentation of the Invoice along with any addendum charges, and my (our) signature(s)
